What does GDPR compliance mean for SMS?

The rules, and how TextBack Pro handles them automatically

UK GDPR applies to any business that processes personal data, including phone numbers collected through SMS conversations. For SMS auto-reply, the three key requirements are a lawful basis for sending, a clear opt-out mechanism and responsible data handling and retention.

TextBack Pro operates on a legitimate interest basis, responding to someone who has just called your number is a recognised lawful basis under UK GDPR. Every SMS includes a simple opt-out path. STOP replies are honoured immediately, logged and respected for all future messages.

Data is stored on UK infrastructure. Callers can request deletion of their data from the dashboard at any time. You do not need to manage any of this manually.

How it works

Compliance built in, not bolted on

1
TextBack Pro operates on a legitimate interest basis
Responding to someone who has just called your business number is a recognised lawful basis under UK GDPR. TextBack Pro uses this basis by default. No additional consent is required from the caller.
2
Every SMS includes an opt-out path; STOP replies are honoured immediately
Every automated message includes a clear opt-out instruction. When a caller replies STOP, they are removed from all future automated messages within seconds. The opt-out is logged and irreversible unless the caller contacts your business directly to re-engage.
3
Data stored on UK infrastructure; deletion available on request
All caller data and SMS transcripts are stored on UK-based servers. From your dashboard, you can delete any individual caller's data at any time to fulfil a subject access or deletion request under UK GDPR.

Common questions

GDPR compliance: your questions answered

TextBack Pro is registered with the Information Commissioner's Office (ICO) as a data processor. As a business using TextBack Pro, you are the data controller and remain responsible for ensuring your use of the platform complies with your own obligations under UK GDPR.
TextBack Pro operates on a legitimate interest basis under Article 6(1)(f) of UK GDPR. Responding to someone who has just called your business number is generally accepted as a legitimate interest. This basis allows an SMS to be sent in direct response to a missed call without requiring prior explicit consent from the caller.
When a caller replies STOP to any message from your TextBack Pro number, they are immediately added to your opt-out list. No further automated SMS messages are sent to that number. The opt-out is logged with a timestamp in your dashboard. Attempting to send a message to an opted-out number is blocked at the system level.
Conversation data is retained for the duration of your active subscription. When a subscription ends, data is retained for a further 30 days to allow for account reinstatement, after which it is permanently deleted. You can delete any individual caller's data manually at any time from the dashboard to comply with a right-to-erasure request.
